Sealing vs. Expungement

Sealing and expungement have distinct differences. When a case is expunged, all data held by the probation officer, prosecution, and arresting agency is erased. The public cannot access this record, though the Florida Department of Law Enforcement will retain it. Sealing a case means that while agency files are closed to the public, they are not erased. Sealing or expungement is an excellent way to clean your name and improve employability. Successfully sealing or expunging your record allows you to deny the charges ever existed under oath, with some restrictions.

Eligibility Requirements

To qualify for expungement or sealing under Florida law, you must:

  • Have been arrested in Florida
  • Not have any current criminal matters under trial or in pretrial diversion
  • Be not guilty by adjudication (not the same as pleading guilty or having adjudication withheld) for any criminal offense
  • Not have previously had a case sealed or expunged
  • Have no outstanding fines, fees, court expenses, or restitution, and have completed all terms of probation if imposed

Exception for Survivors of Human Trafficking

Florida law may allow survivors of human trafficking to have their convictions sealed or expunged, even if found guilty.
The initial step is to apply for and obtain an eligibility certificate from the FDLE. Being eligible does not guarantee automatic approval, as the judge will make the final decision after considering the prosecutor’s objections. For proper handling, consult Tru Printz.
